3. Technology and Platform Protection

  • Any proprietary algorithms or systems

You shall not:

  • Attempt to probe, scan, or test the vulnerability of our systems
  • Breach or circumvent any security or authentication measures

Our Content

The Content is provided for entertainment purposes. We do not guarantee the accuracy, completeness, or suitability of any jokes for any particular audience or purpose.

Trademarks

The Funny Snails name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Funny Snails. You may not use such marks without our prior written permission.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Data Collection: Scraping, data mining, or using automated means to collect content, user information, or any data from the Platform
  • Bulk Downloading: Systematically downloading or copying our joke database or any substantial portion thereof
  • Commercial Exploitation: Using our content to create competing products or services
  • AI/ML Training: Using our content to train artificial intelligence, machine learning models, or any automated systems without express written permission
  • Impersonation: Impersonating any person, entity, or falsely claiming an affiliation with any person or entity
  • Spam: Sending unsolicited communications or using the Platform for promotional purposes
  • Malware: Uploading or transmitting viruses, malware, or any other harmful code
  • Interference: Interfering with other users' enjoyment of the Platform

6. Newsletter Subscription

By subscribing to our daily jokes newsletter, you:

  • Confirm that you are the owner of or authorized to use the email address provided
  • Consent to receive daily joke emails and occasional promotional communications
  • Acknowledge that the newsletter may contain advertisements from third parties
  • May unsubscribe at any time by clicking the "unsubscribe" link in any email

We reserve the right to remove any subscriber who violates these Terms or engages in abusive behavior.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FUNNY SNAILS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Damages resulting from unauthorized access to your information

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Funny Snails, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable laws or regulations

11. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by a recognized arbitration organization in accordance with its rules. The arbitration shall be conducted in the English language.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the United States.

13. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that any content on the Platform infringes your copyright, please send a notice to us containing:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the allegedly infringing material is located on the Platform
  • Your contact information (address, telephone number, and email)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

14. Termination

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections 4, 8, 9, 10, 11, and 12 shall survive any termination of these Terms.
